In this Privacy Policy:

• "we/our" means DDS HOSTING S.R.L (hereinafter referred to as "DDS");

• "third party" means anyone other than us or you;

• our registered office is located at the address in Timisoara, str. Arinului Nr.10A, postal code 300264. We are registered with the Trade Register Timisoara under number J35/1003/2020 under the name DDS HOSTING S.R.L.

Our principles

DDS HOSTING S.R.L ("DDS") respects the privacy of customers and visitors and is committed to protecting their personal data. This Privacy Policy ("Policy") applies to the website dds.ro (collectively referred to as the "Website"). Our policy is based on Regulation 2016/679/EU on the protection of individuals with regard to the processing of personal data and on the free movement of such data ("Regulation").

This Policy describes how we process, including collect, use, share, and protect your personal data when you use our products and services, as well as our Website.

General Terms

The personal data we collect about you.

The information we collect about you and how we collect it may vary depending on the products and services you use and subscribe to, how you have used the products and services, and how you have interacted with DDS even if you are not a customer or what we obtained from a third party who had permission to exchange information with us.

DDS will process your personal data, based on:

1. Execution or conclusion of the contract with you and to fulfill your requests.

2. DDS's legitimate business interests, such as fraud prevention, maintaining the security of our network and services, direct marketing, and improving our services. Whenever we rely on this legal basis to process your data, we assess our commercial interests to ensure that they do not override your rights. Additionally, in some cases, you have the right to object to this processing. For further information, please refer to the Your Rights section in this notice.

3. Compliance with a mandatory legal requirement, including, for example, accounting and tax requirements, which are subject to strict internal policies (such as retention periods), procedures, and your right to restrict the use of your own data, which controls the subject of the legal assistance services to be provided; or

4. Consent given by you when DDS does not rely on another legal basis. Consent can be withdrawn at any time.

• Your browsing history. If you have given permission, DDS collects the categories of websites you have visited from your mobile, device, or PC, such as sports, music, or news. However, we do not have a history of the sites you browse, which is limited to a short period of time to allow for connection. We use this information about interests to send you personalized marketing offers or show you personalized ads.

• For the improvement of the services provided, conversations with the specialists of the Support Department may be recorded and transcribed into text format. If you agree to authorize the recording and transcription, continue the call with our specialists. If you do not want this, please end the call and contact us through other means of communication as presented in this document.

• Additionally, we will obtain information about how you use our products and services, such as:

• The level of services provided to you – for example, network or service issues and other events that may affect our network services or other services;

• Details on how you use certain services or products.

How we use your personal data

We will use your personal data for the following purposes:

1. For providing our service

Processing your order and providing the desired products and services

• For processing the products and services you have purchased from us, as well as keeping you informed about the progress of your order;

• To contact you if the billing details you provided to us are about to expire or we are unable to collect payment;

Improvements and innovations regarding our products and services

We collect anonymous information, without identifiable elements or aggregated for the purpose of improving the services we offer to everyone. None of this analytical data can lead to your identification.

3. Marketing and Personalization of the Services We Offer

Marketing

• As our customer, if you have consented, we will generally keep you informed about new products and services, send you newsletters or white papers, invite you to participate in a study, or inform you about offers, promotions, raffles, or competitions. We customize these messages based on the types of products and services you have purchased from us.

• We can further personalize these messages using location and browsing information if you have authorized us to process this information for this purpose;

• If you have given us permission, we will also contact you to inform you about DDS products and services and those of other companies that we believe may interest you if you do not opt out of receiving such marketing messages from us;

• We will contact you by mail, online, or by phone. We may contact you through our partners, but they will be authorized to process your personal data only on behalf of DDS and in accordance with our policies;

• In order to provide you with relevant advertising, you will also see targeted online advertising based on the use of cookies. This is known as interest-based advertising. It can be done on our website as well as other online media channels, such as social media sites. We may also combine data collected through cookies with other data we have collected. We reserve the right to conduct a financial check when you request the conclusion of a contract with us for any products or services. We may ask for financial and personal details, such as your current address or SSN.

When analyzing your request, we will use profiling and automated decision-making.

We will also use your personal data to verify your identity, to ensure access to your account, and generally for account administration.

Fraud Prevention and Security

We will process data regarding your traffic for anti-fraud protection and fraud detection purposes, to protect our networks and detect misuse of the Services or damage to our networks, for debt recovery, or to detect those who have not paid for the services used.

How We Exchange Personal Data

If necessary, we exchange information about you with:

• DDS affiliated individuals

• Partners or collaborators involved in delivering the products and services you have ordered or used;

• Companies contracted to provide services for or on behalf of DDS;

• Fraud prevention agencies or business scoring agencies

• or other credit scoring agencies; For example, in case of breaches of contract obligations regarding the contract duration, payments, or improper use of products and services, we may report these breaches to fraud prevention agencies or financial profiling;

• Debt collection entities or other debt recovery organizations;

• Law enforcement agencies, government bodies, regulatory organizations, courts, or other public authorities if we have this legal obligation or are authorized by law;

• Third party or body, when such disclosure is necessary to comply with any applicable law or other legal or regulatory requirement;

• Third parties for joint promotions with that third party. They will be responsible for complying with applicable data protection laws;

• Partners carefully selected to contact you about their products and services (which may or may not include DDS products and services);

• Other third parties, when you have given consent for disclosure for authentication and fraud prevention purposes.

Mergers and Acquisitions

If we go through a restructuring or sale procedure to another entity, we will communicate your information to that entity.

Third Parties

If you have purchased products and services through a third party or partner, we often need to exchange information with them as part of managing that relationship and your account - for example, to identify your order and make payment to these third parties or partners.

If we have entered into a contract with a provider or contractor to provide services for us or to provide a service on our behalf, and they may have access to your personal data, we do not authorize them to use or disclose your personal data except in connection with the provision of their services.

Currently, our data is stored in our locations in Romania.

It may be necessary to transfer your information to other affiliated companies or service providers from countries outside the European Economic Area (EEA).

This type of data transfer may occur if our servers (i.e., where we store the data) or our suppliers and service providers are located outside the EEA, or if you use our services and products while visiting countries outside this area.

If DDS transfers your information to a country outside the EEA, we will ensure that your information is adequately protected. In addition, if it is considered that the country does not have laws equivalent to EU data protection standards, then we will require the third party to enter into a legal contract reflecting these standards.

Data Retention Period for Your Personal Data

We will store your information for as long as required by law. If there is no legal requirement, we will only store it for as long as necessary. Unless the law provides otherwise, we will typically process your data for the duration of a contract between you and DDS, plus a period of three years after its termination.

Safeguarding Your Personal Data

DDS constantly analyzes and improves the measures taken to protect your personal data against any unauthorized access, accidental loss, disclosure, or destruction.

Communications over the internet (such as emails) are not secure unless encrypted. Your communications may pass through several countries before being delivered, as this is the nature of the internet.

We cannot accept responsibility for any unauthorized access or loss of personal data that is beyond our control.

We will never ask you to provide your secure, personal, or account information through an unsolicited means of communication. You are solely responsible for keeping your personal and account information secure and for not disclosing it to other individuals. Our website may contain links to third-party websites. We are not responsible for the security and content of such third-party sites. Therefore, make sure to read the data protection and cookie policy of that company before using or providing personal information on their site.

The same applies to any third-party websites or content you access using our products and services.

You may choose to disclose your data in certain ways, such as through social media plugins (including those provided by Google, Facebook, Twitter, and Pinterest) or using third-party services that allow you to publicly post reviews or other information, and a third party may use that information.

Social media plugins and social media applications are operated directly by the social network and are subject to the terms of use and policies of those networks regarding data protection and cookies. You should make sure you are aware of these.

Rights of the Data Subject

Right to Rectification of Personal Data

You have the right to rectify the data held about you if it is incorrect. If the data we hold about you needs to be updated or if you believe it may be incorrect, you can log into your manage.dds.ro account to update it or contact the Support Department.

Right of Access to Personal Data

You have the right to request a copy of the personal data DDS holds about you by sending an email to gdpr@dds.ro or submitting a written request to the DDS headquarters.

Right to Data Portability

You have the right to take your own data with you that you have provided to us in certain circumstances, as provided by the Regulation.

Right to Object to the Use of Personal Data

In certain circumstances, you have the right to object to DDS processing your personal data.

To stop receiving marketing messages:

If you no longer wish to receive marketing messages from DDS regarding our services and/or those of our partners, you can opt out of all marketing communications or just selected methods (email, SMS, MMS, phone, or post).

There are various methods to opt out of receiving marketing messages:

• Send an email to gdpr@dds.ro for instructions.

• Click on the unsubscribe link at the end of a marketing email or text;

If you opt out of marketing messages, it doesn't mean you won't receive service-related messages. You will continue to receive those (unless otherwise indicated).

Right to Restrict the Use of Your Personal Data

If you believe the data we hold about you is incorrect or should not be processed, please contact the Support Department who will direct you to the Data Protection Officer for a discussion about your rights. In certain circumstances, you have the right to request restriction of processing.

Right to Erase

DDS will process and retain your data only for as long as necessary but no more than 365 days if the account is inactive. In certain circumstances, you have the right to request us to delete your personal data we hold. We may have legal grounds for processing your personal data even after termination of your contract with DDS (e.g., in case of litigation).
